SPEAKING FOR THE EVIDENCE
Shooting reconstruction, police shootings, firearms, ballistics, and toolmarks, and are my primary fields of expertise.
As your expert, I will inform you of both the strengths and weaknesses of the case in order for you to make educated decisions based on the facts.
Conclusions will be based on the generally accepted protocols and methodologies in the scientific community and to the standards of meeting all prongs of Daubert/Frye Challenges.
TRAINING - EDUCATION - EXPERIENCE
During my career I have been involved in literally thousands of cases and bring with me the experience of 25+ years as member of the Massachusetts State Police followed by my current work as an independent consultant.
I was the Commanding Officer of the Ballistics Section which provided forensic services for 350 cities and towns, all State and Federal Agencies, and the military services, Station Commander of the Revere Barracks, and Shift Commander of Troops "A" and "H", and a member of the Staff Inspections Unit which conducted internal investigations, audits, and inspections.
U.S. Army military service was in Ordnance and Small Arms, and I have worked at the Aberdeen Proving Ground and in Europe in the areas of internal, external, and terminal ballistics.
Formal education includes two Masters Degrees and a Bachelor of Science Cum Laude.
Toolmark and technical experience acquired through work in mechanical engineering, machining operations, tool & dies, firearms construction and design, and the removal of toolmarks from critical jet engine surface areas.
WHAT REALLY HAPPENED?
Peter Montoya of Salt Lake City did not fire the fatal shot but spent 6 years in prison based on the misrepresentative testimony of police and preposterous version of events outlined by the prosecution.
The jury heard how he fired out the passenger side window from a truck killing a young man and wounding another.
In reconstructing the trajectory, location of discharged cartridge cases, spatial and angular relationship of the victim's vehicle to the truck I proved that the driver of the truck, not Montoya, was the only person capable of shooting and testified before the original trial judge in the Motion for Post Conviction Relief.
The motion was granted in 2006 and a new trial ordered. The driver of the truck had been killed in a police shootout shortly after the incident which left Montoya as the one to hang the shooting on.
Montoya's defense attorney did not retain a ballistics expert to review the state's absurd theory prior to trial, and it is obvious why the prosecution never called a ballistics expert but called only the incompetent or unscrupulous detectives to testify to scientifically impossible facts.
No stone will be left unturned in seeking the truth.
